This page is everything you should know before you send a letter. The three most important things are at the top.
1. Your letter may be made public
This is the most important thing about Night Letters. The tier you pick on the form determines how your letter can be used:
- Just for you — only I read it. It appears nowhere.
- Can be read — your letter and my reply may appear in the “read others’ letters” panel and the archive page, showing only your signature.
- Can be spoken about — in addition to the above, the content may be discussed in a podcast or article, again using only your signature.
- Something deeper — you’d like a further conversation. This tier is never made public.
Whether something goes public is my decision, but never beyond the tier you chose. Pick the first tier and I will never bring it out; pick “can be read” and I may still decide against it because the content feels too private.
When published, only your signature is shown — no email, no city, nothing that could identify you. If your letter contains a real name, a company, or any other identifying detail, I remove or rewrite it before publishing.
You can change your mind at any time. Write to me about a letter that’s already public and I’ll take it down. No reason needed.
2. Your letter stays yours
The words you write and the audio you record remain yours throughout. I don’t acquire ownership, and you don’t give up any rights.
When you choose “can be read” or “can be spoken about”, you are granting me a licence to use it within these limits:
- Only on the Night Murmur site, newsletter, podcast and related content
- Never beyond the tier you chose
- Only under your signature, never a real name
- Never resold, never sublicensed, never used in advertising
- Never used to train any AI model
You can revoke this licence at any time. Write to me and I’ll take down anything already published.
Things that have already gone out — a podcast episode already released, a newsletter already sent — can’t be recalled, but I’ll stop using them going forward. Worth weighing when you pick a tier.
The other direction: my replies are mine. Keep your copy, share the link, but please don’t republish them in full elsewhere.
3. You don’t have to leave an identity
Writing a letter needs only a signature, and that signature can be anything. Email is optional — leave it out and I can’t write back, but your letter will still be read.
What I receive: your signature, the category you chose, your country and city, and what you wrote or recorded.
Recordings
If you choose to speak instead of write, the audio is stored on the site and treated exactly like written content — according to the tier you chose.
Your original recording is never played publicly. Even at the “can be spoken about” tier, anything I say in a podcast is in my own words. Your voice is not used.
Replies
If you leave an email:
- You’ll receive a confirmation email straight away, containing what you wrote
- Later, if I write a reply, you’ll receive an email with a link to it
I can’t promise to reply to every letter. I read them alone and I write them alone.
Newsletter
If you leave an email you’ll be added to the Night Murmur list and will occasionally hear about new writing. Every email has a one-click unsubscribe at the bottom, and I won’t ask why.
If you only want a reply and nothing else, just say so in your letter.
How long I keep it
- Letters not made public — kept 2 years, then deleted
- Published letters and replies — stay on the site until you ask for removal
- Audio recordings — follow the same schedule as the letter
You can ask for earlier deletion at any time. But if you didn’t leave an email, I have no way to confirm which letter is yours — that’s the cost of anonymity. Worth a thought before you send.
Legal basis
- Your consent — submitting the form means you agree to your content being handled according to the tier you chose, and grants the licence described above. Both are withdrawable at any time.
- Legitimate interests — IP logging for site security.
What follows applies across everything at Night Murmur.
Who handles your data
Anny Chen, operating Night Murmur, based in Vancouver, British Columbia, Canada. Under EU and UK law I am the data controller for your personal data.
No team, no assistant, no shared account. Only I can see your data.
Contact: be.with.anny@gmail.com
What will not happen
- I do not sell your personal data
- I do not share it with marketing partners, ad platforms, or data brokers
- I do not use your content to train any AI model
- I do not add you to a newsletter without your consent
There is one exception where I would disclose without your consent: where the law compels it, or where someone — including you — is in immediate danger of serious harm. This boundary is common to all helping work. I’m writing it down because you have the right to know it in advance.
What the site records automatically
When you submit any form, the site logs your IP address and browser information for 90 days. This is used only to prevent bot spam. It is not used to profile you.
Service providers that technically touch the data
- Website host — form submissions live in the site database
- Email provider — sending and correspondence
- Video call tool (1:1 only) — the live connection itself
These providers may only process data on my instructions and may not use it for their own purposes.
Where the data lives
I’m based in Canada, and service providers may be located in Canada, the United States, or the EU. If you are in the EU or the UK, your data may therefore be transferred outside your region. Such transfers rely on the EU Standard Contractual Clauses, the UK International Data Transfer Addendum, or an adequacy decision.
Your rights
Wherever you live, I extend the same rights to everyone:
- See it — request a copy of everything I hold about you
- Correct it — fix anything inaccurate
- Delete it — request erasure
- Take it — receive your data in a readable format
- Object or restrict — ask me to stop or limit certain processing
- Withdraw consent — at any time, no reason needed
- No discrimination — exercising any of these never affects the service you receive
Write to be.with.anny@gmail.com and I’ll complete it within 30 days.
Region-specific notes
- EU (GDPR) — you may lodge a complaint with your national data protection authority.
- UK (UK GDPR) — you may complain to the Information Commissioner’s Office (ICO).
- Canada (PIPEDA) — you may complain to the Office of the Privacy Commissioner of Canada.
- California (CCPA / CPRA) — you have the right to know the categories collected, and to request deletion and correction. I neither sell nor “share” personal information, so no opt-out is required.
- Other US states (Virginia, Colorado, Connecticut, Utah, Texas and others) — equivalent access, correction, deletion and portability rights apply.
- Japan (APPI) / Korea (PIPA) / Singapore (PDPA) / Australia (Privacy Act) — equivalent access and correction rights apply; cross-border transfers follow the mechanisms above.
- Taiwan (PDPA) — you may request access, review, copies, correction, cessation of processing, and deletion.
Minors
All services are for people aged 18 and over. I don’t knowingly collect data from minors; if I find that I have, I delete it.
This is not therapy
I am not a psychologist, counsellor, or medical professional, and nothing here is therapy, counselling, or healthcare. It cannot replace them.
If you are in a mental health crisis, please contact local professional services or emergency services.
Changes to these terms
If anything changes, I’ll update the version date. For substantive changes, I’ll email anyone with sessions in progress.
Anything unclear, write and ask: be.with.anny@gmail.com
