This page is everything you should know before booking.


1. None of this is ever made public

What you say in a session, the notes I write, and any recordings that exist — none of it appears on the site, in a podcast, or as a teaching example. Not even de-identified.

This differs from Night Letters. There, publication is an option you can choose. Here it isn’t, and it won’t be.

2. Recording is off by default

I will never record audio or video without asking you first.

If a session comes up where I think a recording would help, I’ll ask before I start, and you can simply say no. Saying no changes nothing — the conversation goes ahead exactly the same way.

I ask every time. Agreeing once does not mean recording continues.

You can also change your mind about a recording you already agreed to. Tell me, and I’ll delete it and write back to confirm it’s gone.

A recording has exactly one purpose: so that before I see you again, I can check that what I heard hasn’t drifted. It will not be used for marketing, not used as a teaching example, not used to train any AI model, and no part of it will ever be made public.

If I need supervision as part of coach training, I’ll explain separately what it’s for and who would hear it, and ask for your consent. You can decline, and it changes nothing.

3. What I record

What you type into the form: what you’d like to be called, your email, where you’re based, the pronouns you’d like me to use, which plan you’re interested in, and what you write about where you are right now.

Country and pronouns are optional. Filling them in helps me use the right language with you; leaving them blank changes nothing about the service.

What comes out of the sessions: the date and status of each conversation, and the notes I write during or after — what I heard, patterns I noticed, what I want to pick up next time.

This form does not add you to a newsletter. Client records and the mailing list are kept separate and don’t flow into each other.


How long I keep it

  • Enquiry only, never started — deleted after 12 months
  • Session records and notes — kept 3 years after the last conversation, then deleted
  • Recordings — kept a maximum of 90 days, then deleted

You can ask me to delete any of it sooner. I won’t ask why.

Fees and plans

Fees are in US dollars, payable before each session or at the start of a plan. What each plan includes, and its price, is as shown on the booking form.

Plans are valid for twelve months from the first conversation. If something comes up and you need longer, write to me.

Rescheduling and cancellation

Need to move a session? Just let me know. Something came up last minute? That’s fine too — we’ll find another time.

If you’ve paid for sessions you haven’t used and decide not to continue, the unused portion is refunded in full. Just write to me. No reason needed.

The same applies in reverse: if I think what you need is professional mental health support rather than companionship, I’ll say so directly and refund the unused portion.

Legal basis

  • Performance of a contract — to deliver the sessions you booked, I need your contact details and session records
  • Your consent — country, pronouns and recordings rest on your consent and can be withdrawn at any time. Withdrawal doesn’t affect processing that was lawful before it.

What follows applies across everything at Night Murmur.

Who handles your data

Anny Chen, operating Night Murmur, based in Vancouver, British Columbia, Canada. Under EU and UK law I am the data controller for your personal data.

No team, no assistant, no shared account. Only I can see your data.

What will not happen

  • I do not sell your personal data
  • I do not share it with marketing partners, ad platforms, or data brokers
  • I do not use your content to train any AI model
  • I do not add you to a newsletter without your consent

There is one exception where I would disclose without your consent: where the law compels it, or where someone — including you — is in immediate danger of serious harm. This boundary is common to all helping work. I’m writing it down because you have the right to know it in advance.

What the site records automatically

When you submit any form, the site logs your IP address and browser information for 90 days. This is used only to prevent bot spam. It is not used to profile you.

Service providers that technically touch the data

  • Website host — form submissions live in the site database
  • Email provider — sending and correspondence
  • Video call tool (1:1 only) — the live connection itself

These providers may only process data on my instructions and may not use it for their own purposes.

Where the data lives

I’m based in Canada, and service providers may be located in Canada, the United States, or the EU. If you are in the EU or the UK, your data may therefore be transferred outside your region. Such transfers rely on the EU Standard Contractual Clauses, the UK International Data Transfer Addendum, or an adequacy decision.

Your rights

Wherever you live, I extend the same rights to everyone:

  • See it — request a copy of everything I hold about you
  • Correct it — fix anything inaccurate
  • Delete it — request erasure
  • Take it — receive your data in a readable format
  • Object or restrict — ask me to stop or limit certain processing
  • Withdraw consent — at any time, no reason needed
  • No discrimination — exercising any of these never affects the service you receive

Region-specific notes

  • EU (GDPR) — you may lodge a complaint with your national data protection authority.
  • UK (UK GDPR) — you may complain to the Information Commissioner’s Office (ICO).
  • Canada (PIPEDA) — you may complain to the Office of the Privacy Commissioner of Canada.
  • California (CCPA / CPRA) — you have the right to know the categories collected, and to request deletion and correction. I neither sell nor “share” personal information, so no opt-out is required.
  • Other US states (Virginia, Colorado, Connecticut, Utah, Texas and others) — equivalent access, correction, deletion and portability rights apply.
  • Japan (APPI) / Korea (PIPA) / Singapore (PDPA) / Australia (Privacy Act) — equivalent access and correction rights apply; cross-border transfers follow the mechanisms above.
  • Taiwan (PDPA) — you may request access, review, copies, correction, cessation of processing, and deletion.

Minors

All services are for people aged 18 and over. I don’t knowingly collect data from minors; if I find that I have, I delete it.

This is not therapy

I am not a psychologist, counsellor, or medical professional, and nothing here is therapy, counselling, or healthcare. It cannot replace them.

If you are in a mental health crisis, please contact local professional services or emergency services.

Changes to these terms

If anything changes, I’ll update the version date. For substantive changes, I’ll email anyone with sessions in progress.
